PROBLEM TO BE SOLVED: To provide an occupant crash protection device and an occupant crash protection method capable of increasing an occupant constraint force by turning a seatback when a side impact is detected, and preventing any secondary collision by integrally moving an occupant together with a seat. SOLUTION: When a side impact is detected, right and left drive means 20A, 20B relatively move a seat rail inner 10c on the non-collision side backward of a vehicle with respect to a seat rail inner 10c on the collision side, a front side 4a forming the occupant supporting surface of the seatback 4 is turned so that the direction normal to the surface is directed to the non-collision side, and a part of the load applied from the side during the collision is received by the back of the occupant to mitigate stress in the loading face. The seat back 4 reliably interferes the back of the occupant to generate normal stress in the occupant from the seat back 4, the friction force between the seat back 4 and the occupant is increased proportional to the normal stress, and an occupant constraint capacity is enhanced to prevent a secondary collision.
