A mobile communication system wherein an apparatus at a data transmitting end uses a data channel and a control channel to retransmit, based on a receipt confirming signal from an apparatus at a data receiving end, a transport data block. The apparatus at the data transmitting end comprises a maximum number-of-retransmittals managing part for managing the maximum number of retransmittals of the transport data block associated with the transmission power ratio of the data channel to the control channel or associated with the size of the transport data block; and a retransmitting part for retransmitting the transport data block until the number of retransmittals of the transport data block reaches the maximum number of retransmittals associated with the transmission power ratio of the transport data block or associated with the size of the transport data block.
