PROBLEM TO BE SOLVED: To provide an organic EL element with high luminance, few occurrences of defects, and a long life. SOLUTION: An organic compound layer held between a positive electrode and a cathode is composed of at least two layers including a light-emitting layer and a buffer layer or more, wherein at least one layer of organic layers composed of a charge-transporting polyester having a repeat unit that contains at least one type selected from structures indicated in the formulas (I-1) and (I-2) as a partial structure, and the buffer layer is provided contacting to the positive electrode and contains one type charge injecting material or more.
