<p><P>PROBLEM TO BE SOLVED: To provide a frequency band allocating apparatus and a frequency band allocating method which can use a plurality of frequency bands and allocate transmission information according to features of each frequency. <P>SOLUTION: The frequency band allocating apparatus is provided with a frequency band selecting means for selecting usable frequency bands from among an exclusive frequency band exclusively allocated to each common carrier, a registration system frequency band capable of being used by a registered common carrier and unlicensed frequency band to be used if predetermined conditions are met; and a frequency band allocating means for allocating a frequency band to a user from the usable frequency bands, so that QoS required by the user is satisfied and frequency utilization efficiency of a system is the maximum.
