PROBLEM TO BE SOLVED: To provide a content data transmitting device capable of changing contents of content data transmitted to a client device based on whether communication connection with the client device is performed via a communication network of a predetermined characteristic, its control method, and a program of making a computer function as the content data transmitting device. SOLUTION: A determining section 44 determines whether communication connection with the client devices 14a and 14b is performed via the communication network of a characteristic indicated by communication network characteristic information to be stored in a storage section 50. A content data acquiring section 46 reads a content data acquiring condition from the storage section 50 based on a determination result by the determining section 44, acquires content data based on the content data acquiring condition, and makes a content data transmitting section 48 transmit it.
