PROBLEM TO BE SOLVED: To solve the problem of degradation in condensing efficiency and color mixture that accompany the laminating structure of an optical filter, and to improve precision in black reference due to light shielding pixel. SOLUTION: Relating to a CMOS image sensor, an embedded color filter is provided in the region corresponding to the light receiving region of a photodiode in the insulating film of the upper laminating film. The lower surface of the color filter is arranged below the position of lower surface of a metal wiring film which is the bottom layer of the upper laminating film. Thus, the interval between the photodiode and the color filter or micro lens is reduced to improve condensing efficiency or prevent color mixture. At the pixel for detecting black reference, a light shielding film, for example a light shielding medium or black filter, is provided instead of an embedded optical filter.
