PROBLEM TO BE SOLVED: To provide an information recording and reproducing apparatus in which overwriting-recording can be performed for an already reproduced part when storage capacity is deficient. SOLUTION: When it is determined that capacity required for recording video data does not exist in a recordable region (NO in step S104), it is determined whether program data of "no protection" exist or not (step S112). When the program data of "no protection" exist, the program data are erased and allotted to the recordable region (step S114). Further, it is determined whether program data of "partial protection" exist or not (step S116). When the program data of "partial protection" exist, the already reproduced part is erased and the region is allotted to the recordable region based on information of resume point (step S118).
