PROBLEM TO BE SOLVED: To shorten a time required for encoding and to reduce a disk space required for encoding.

SOLUTION: There are provided a virtual receiving buffer; an adding unit and a subtracting unit for varying an amount to occupy the virtual receiving buffer based on increase of buffer occupancy received by a receiving buffer in the case of reproduction and an amount of generated bits for each picture in reproduction; a code amount condition deriving unit for deriving conditions of generated bits for each picture in the reproduction based on the varied buffer occupancy; a code amount condition setting unit for setting conditions to encode non-encoded motion picture data while satisfying the derived conditions of the generated bits; and a motion picture encoding unit for performing encoding according to the set conditions.
