PROBLEM TO BE SOLVED: To provide an apparatus of assigning a slot which can assign the slots of upper and lower links flexibly according to the state, etc. of a traffic in a communication system adopting an FDD/TDD system. SOLUTION: The apparatus of assigning the slot in a mobile communication system communicates by using a frequency division duplex type/time division duplex system between a radio base station and a mobile station. The apparatus of assigning the slot includes a traffic characteristic detecting means for detecting the characteristic of an input traffic, upper and lower slot assignment priority order judging means for judging whether either assignment of the upper channel or lower channel slot should be preferentially performed based on the priority of the traffic specified from the characteristic of the detected input traffic, and a slit assigning means for assigning the slots of the upper and lower channels to the mobile station based on the judged result.
