Disclosed is a transmitting apparatus generating a packet having a format suitable to transmit transport stream (TS) packet type data. The transmitting apparatus comprises: a packet generating unit generating a packet including a header and a payload on the basis of an input stream; and a signal processing unit processing a signal of the generated packet. A base header forming the header includes a first field representing a packet type of an input stream. When the first field is set to a value representing that the packet type of the input stream is a TS packet, the base header includes a second field representing the number of the TS packets included in the payload, and a third field set to a first value representing the absence of an additional header or a second value representing the presence of the additional header. When the third field is set to the second value, the additional header includes a fourth field representing the number of null packets removed from at least one TS packet group formed by consecutive TS packets. The null packet removed from the respective TS packet groups is a null TS packet consecutively preceding a first TS packet included in the respective TS packet groups among the plurality of packets included in the input stream.
