PROBLEM TO BE SOLVED: To provide an optical disk device capable of surely recording data only to the data area by exactly identifying the boundary between a mirror area and the data area of even an optical disk having any surface condition of a mirror area surface, minimizing the useless processing time of reading processing by drastically reducing the number of the reading processing until the area is discriminated, and permitting rapid starting of recording and reproducing of the data by further speeding up the processing during recording and reproducing and a method for discriminating the optical disk area. SOLUTION: The mirror area and data area of the optical disk 200 are surely discriminated even if the surface condition of the mirror area surface is any state, like the information recording state and information printing state and further the flawing state and fouling state in the mirror area of the optical disk 200.
