PROBLEM TO BE SOLVED: To provide a modified polyester composition that produces fiber developing improved deep color tone or excellent color brightness, when it is dyed with a cationic dye, additionally, having excellent physical properties, for example, strength or the like. SOLUTION: This polyester composition includes a modified polyester into which a sulfonic acid phosphonium salt represented by a specific chemical structure is copolymerized. In this case, (A) the amount of the copolymererized sulfonic acid phosphonium salt is 0.1 to 10 mol% per the acid components constituting the modified polyester, (B) the amount of the benzoic acid and/or the benzoic acid derivative is 0.1 to 20 mol% based on the sulfonic acid phosphonium salt, (C) the amount of the cyclic trimer constituted from one unit of the component represented by general formula (I) and two units of the alkylene terephthalate is 0.1 to 1 wt.% based on the whole weight of the modified polyester composition and a method for producing the modified polyester by using a vent type extruder is provided.
