<P>PROBLEM TO BE SOLVED: To provide a nonaqueous electrolyte battery capable of improving safety, especially, an overcharge property without greatly changing a conventional battery configuration. <P>SOLUTION: This nonaqueous electrolyte battery is provided with a positive electrode, in which a positive electrode active material layer 2 containing a plurality of positive electrode active materials is formed on the surface of a positive electrode collector 1, a negative electrode having a negative electrode active material layer 4, and a separator 3 arranged between the both electrodes. The positive electrode active material layer 2 is formed of two layers 2a and 2b containing different positive electrode active material constituents. Between the two layers 2a and 2b, the layer 2b on the positive electrode surface side contains a positive electrode active material showing the highest heat stability among positive electrode active materials as a principal constituent.
