PROBLEM TO BE SOLVED: To improve fixing characteristic by stabilizing a contact nip area where a nip is formed by stretching and laying a heat resistant belt by a stretching and laying member and winding the heat resistant belt around a thermal fixing roll from a tangent at a pressing part between the thermal fixing roll and a pressure roll with a simple constitution. SOLUTION: The fixing device is equipped with the thermal fixing roll 1, the pressure roll 2 pressed on the thermal fixing roll 1, the heat resistant belt 3 wound around the outer circumference of the pressure roll 2 and moving while it is held between the thermal fixing roll 1 and the pressure roll 2, and the belt stretching and laying member 4 for stretching and laying the heat resistant belt 3, and fixes an unfixed toner image formed on sheet material 5. In the fixing device and the image forming apparatus, the belt stretching and laying member 4 is arranged at a position where a fixing nip is formed by winding the heat resistant belt 3 around the thermal fixing roll 1 from the tangent at the pressing part between the thermal fixing roll 1 and the pressure roll 2 on a more upstream side in the moving direction of the heat resistant belt 3 than the pressing part, and is lightly pressed on the thermal fixing roll 1 from the inside of the heat resistant belt 3, and its lightly pressed part is formed of a flat surface 4g.
