PROBLEM TO BE SOLVED: To provide an optical recording and reproducing device in which recording and reproducing to/from a recordable optical disk having two recording layers on a single surface, are stably conducted. SOLUTION: In the recording and reproducing device of the optical disk 1 having a plurality of recording layers 2 and 3 on the single surface, prior to the operation in which information is recorded by a user, at least one of 7b-1, 7b-2, 7b-3 and 7b-4 in the region of the outer peripheral side or the region of the inner peripheral side adjacent to user recording regions 7a where the user can record the information with respect to at least one of the recording layers 2 and 3, is preliminarily written. According to the optical recording and reproducing device, recording and reproducing are stably conducted in the vicinity of the outermost periphery/innermost periphery of the back recording layer 2 and a highly reliable optical disk is obtained.
