PROBLEM TO BE SOLVED: To provide a data transmitting device and a data transmission method, having a data transmission function that is excellent in practicality. SOLUTION: Program data following a broadcast signal received via an antenna 1 are recorded on an HDD5. A plurality of series of program data recorded on the HDD5 are transmitted to a DVD-R16 for storage. It is determined whether the maximum numbers of program data that become a total number of data that does not exceed the maximum numbers of data that the DVD-R16 can record in the plurality of series of program data have been recorded on the HDD5. When it is determined that the maximum numbers of program data have been recorded, the maximum numbers of program data are read from the HDD5 for transmitting to the DVD-R16 and are written onto the DVD-R16 for storage.
