<P>PROBLEM TO BE SOLVED: To provide an object image extraction device and an object image extraction method capable of forming an extracted resultant image having no shade or lack of a pixel and causing no fluctuation due to a shade in the position and size of an object inside the image. <P>SOLUTION: An objective image formed by photographing a person is inputted from an object image DB 3. A person extraction processing part 10 converts the inputted objective image into that with a gray scale, and then, filtering processing using the Gabor function is carried out, and consequently, an image, from which shade information is removed while maintaining edge information of the image, is obtained. A background image including no photographed person image is inputted from a background image DB 4 to be converted into an image with a gray scale, and filtering processing using the Gabor function is carried out, and an image, from which shade information is removed while maintaining edge information about the background, is obtained. On the objective image and the background image, on which Gabor function processing is carried out, background differential processing is carried out. Then, processing for forming a convex closure is carried out on the pixels left as a result.
