PROBLEM TO BE SOLVED: To perform recording of information to an information recording medium having a plurality of recording layers in a short period of time. SOLUTION: When user data are recorded to an information recording medium having a plurality of recording layers and an unrecorded layer in which user data are not yet recorded exists in the plurality of recording layers, information for specifying the unrecorded layer is recorded in any recording layer (step 519).
