PROBLEM TO BE SOLVED: To provide a fixing device for preventing a thermal rotating body from being damaged by a peeling claw urged on the thermal rotating body such as a roller and a belt thermally fixing toner adhered to recording paper, and also to provide an image forming apparatus using it. SOLUTION: The fixing device 1 is provided with a fixing roller 3 for performing thermal fixing by sandwiching the recording paper P adhering the toner together with a pressure roller 4, and the peeling claw 6 urged to the fixing roller 3 for peeling the recording paper P from the fixing roller 3. The peeling claw 6 has an arm 10 contacted on the recording paper P conveyed to be protruded on the way of a conveying path of the conveying recording paper P, and is swung by the conveyed recording paper P.
