PROBLEM TO BE SOLVED: To provide a lithium ion secondary battery and its battery pack by a protection method with high safety during overcharging. SOLUTION: This is the lithium ion secondary battery and the battery pack having a non-recovery current breaking function provided with a recovery type safety element to attenuate the current by tripping when the temperature of the battery rises, and a safety valve film to break the current when the inner pressure of the battery rises, and at the time of overcharging, at first the recovery type safety element is actuated and attenuates current value, and by further continuing charging by the attenuated current, the inner pressure of the battery is raised, and the current breaking mechanism is actuated and safety at the overcharging is secured. This recovery type safety element is a PTC element or a thermostat, the actuation temperatures are made as 70°C to 100°C, the current values are attenuated to 30 mA to 200 mA, and actuation pressures of the current breaking mechanism are made as 0.4 MPa to 1.6 MPa.
