PROBLEM TO BE SOLVED: To make it possible to reduce encoder and decoder occupying periods for rate conversion dubbing processing by changing a dubbing method in accordance with a recording bit rate of AV data when rate conversion dubbing is carried out. SOLUTION: A recording and reproducing device 10 is provided with; an HD 15 which records AV data; an input and output I/F 16 in which a DVD 17 is mounted; a dubbing means 21a which dubs by either a rate conversion dubbing method which dubs after re-encoding or a high-speed dubbing method which dubs without re-encoding; and a dubbing determination means 21b which compares a recording bit rate set at a time when the rate conversion dubbing is carried out with a recording bit rate when AV data to be dubbed are recorded, and determines which method is taken for dubbing the AV data, the rate conversion dubbing method or the high-speed dubbing method. The dubbing means 21a carries out the high-speed dubbing when the recording bit rate of the AV data is below the recording bit rate set at a time when the rate conversion dubbing is carried out.
