PROBLEM TO BE SOLVED: To provide a digital information recording and reproducing method which can make effective use of the region of a recording medium by changing a consecutive recording region in accordance with the bit rate of an AV stream to be recorded, and also provide a digital information recording and reproducing device thereof. SOLUTION: A reading means 108 reads sector information/AV stream from a rewritable recording medium 109 to which each sector assignment information is recorded, and a writing means 107 writes the sector information/AV stream to the recording medium 109. A bit rate detection means 102 detects the bit rate of the AV stream to be recorded. An AV stream control means 103 makes the bit rate thus detected a writing bit rate, searches for a consecutive vacant capacity region having a consecutive recording amount which is at least a minimum consecutive recording amount which guarantees consecutive reproduction according to the bit rate, and controls the writing means 107 so that the AV stream may be sequentially written to the consecutive vacant capacity region thus obtained.
