PROBLEM TO BE SOLVED: To realize a means for protecting confidentiality on an IP network and transmitting AV contents such as an MPEG, wherein copyright of digital broadcasting, a DVD disk and so on is protected while inheriting its format information and copy control information. SOLUTION: In a packet transmitting and receiving means comprising a data inputting means for respectively inputting AV data and non-AV data, an encrypted data generating means for receiving an output of the data inputting means and "executing encryption or encrypted information header attachment" according to a specified transmission and reception condition and a packet header attaching means, in a packet transmitting means, the encrypted data generating means is provided with an authentication means, an encryption means and an encrypted information header attaching means, and a control means for either making encryption to/not to be executed in the encryption means or attaching an encrypted information header in the encrypted information header attaching means according to the specified transmission and reception condition.
