PROBLEM TO BE SOLVED: To provide a detecting device and a detecting method which enable determination in a short time with a sufficient precision whether or not an object detected in a region is an obstacle, and reduction its facility cost. SOLUTION: The detecting device is provided with a laser radar 10 which performs a scanning of a predetermined region, a radar information creation means 21 for finding three-dimensional radar information from information on a distance detected from this laser radar 10 and information on its scanning direction, an object detection means 22 for detecting objects existing in the predetermined region from the three-dimensional radar information, a region recognition means 23 which recognizes the predetermined region as a plurality of split regions split in the travelling direction of the object, and an obstacle judgment means 24 which judges that the obstacle stays, when at least one object stays in one of the split regions for a predetermined period of time continuously.
