PROBLEM TO BE SOLVED: To produce an image certainly not containing a body in motion by detecting the body in motion in the image. SOLUTION: An image producing apparatus is provided with a reference image setting part setting reference image data and a body in motion detection part detecting the body in motion in a reference image by using the reference image data and one image data and setting a body in motion range containing the body in motion in the reference image. Furthermore, the image producing apparatus is provided with a substitution range image detection part searching for the image not containing the body in motion in an image range corresponding to the body in motion range in the reference image in the images expressing two or more image data and then setting the detected image as the substitution range image and an image synthesizing part synthesizing an image data expressing the image not containing the body in motion by using the image data expressing the image in the image range excluding the body in motion range in the reference image and the image data expressing the substitution range image, in the reference image data.
