PROBLEM TO BE SOLVED: To provide a method of determining communication permission, in a mobile communication system with which circuit scale and power consumption can be reduced. SOLUTION: In the method of determining communication permission in the mobile communication system, when a communication permission request including selected one piece of signature pattern data is made from a mobile terminal 2, at permitting of communication, a base station 1 returns the received signature pattern data to the mobile terminal, as they are; but when communication is not permitted, the base station returns the data in a non-signal state, and when making the communication a standby state, the base station returns the received signature pattern data after inverting codes thereof, and the mobile terminal 2 then determines whether communication can be permitted, on the basis of the returned signal data. An AICH generating section 70 of the base station 1 adds a plurality of pieces of signature pattern data, including the signature pattern data selected in the mobile terminal 2, and then performs weighting and spread modulation.
