<P>PROBLEM TO BE SOLVED: To provide a luminescent material capable of emitting ultraviolet rays or emitting both ultraviolet rays and near infrared rays, and provide an optical element using the material. <P>SOLUTION: The luminescent material has an AlN containing section and a ZnO containing section, and the ZnO containing section is held by the AlN containing section. Er is doped into the ZnO containing section, and the content of Er is distributed unevenly in the ZnO containing section. The optical element (2) has a light-emitting section (21) composed of the luminescent material. Accordingly, not only ultraviolet rays can be emitted or both ultraviolet rays and near infrared rays can be emitted, but also a band discontinuity is increased, carriers can be confined stably in ZnO, and the light-emitting section can be light-emitted stably even at a high temperature. A luminous wavelength can be controlled widely especially when a quantum well structure is formed.
