PROBLEM TO BE SOLVED: To provide an AV data recording method and an AV data recording apparatus in which real time recording of AV data can be performed while recording backup data even when a data transfer rate is changed during recording of AV data. SOLUTION: Before recording of AV data, an AV file provided with an unrecorded region of the prescribed size or more is made, a backup data recording position is decided in the AV file region by a backup data recording position deciding circuit 15 while securing always the unrecorded region by expanding the AV file region during recording of the AV data, backup data can be recorded while securing real time recording of the AV data even when a transfer rate during recording of the AV data is changed by recording successively update data other than the AV data and recording position information of the update data in the backup data recording position as backup data.
