PROBLEM TO BE SOLVED: To generate a code stream from which the contents of an image can be grasped at an early stage of progressive decoding.

SOLUTION: A region determining processor 34 for determining whether a region is character region or non-character region per tile is provided on an encoder for performing coding processing for an image, and a result of the determination is inputted into a code stream generation processor 37. The processor 37 generates a progressive code stream of a specific progressive order, and controls the hierarchy configuration of the code stream in units of tile according to the result of region determination.
