PROBLEM TO BE SOLVED: To provide a device and a method for determining a battery state capable of determining the discharge state of a battery by a simple circuit constitution. SOLUTION: A reference voltage value is inputted to a DA converter 24 as a digital value and converted to an analog reference voltage. The reference voltage and an output voltage of the battery 12 for supplying driving power to a power load are inputted to a comparator 26. A comparison result signal indicating the comparison result is outputted. When the discharge state during the supply of the driving power to a voltage load 16 of the battery 12 is determined on the basis of the inputted reference voltage value and the comparison result signal, a control part 22 controls so as to selectively input one of a plurality of the predetermined reference voltage values to the DA converter 24.
