PROBLEM TO BE SOLVED: To provide an optical disk device and a disk discriminating method capable of discriminating an optical disk into which information is recorded in a high density recording mode while adverse effect being applied onto an existing mechanism is made small. SOLUTION: In the optical disk device in which recording/playing-back is conducted in accordance with a second format having higher recording density than a first format that is defined as an optical disk recording/playing-back standard, a binary code is beforehand set to indicate that the optical disk is in a state where recording is conducted in accordance with the second format. When recording is to be conducted for an optical disk in accordance with the second format, a control means is provided to record the binary code in an un-set area that is located at the inner periphery side than a data area of the optical disk where setting is performed based on the first format.
