PROBLEM TO BE SOLVED: To provide an image processing apparatus and an image processing method capable of outputting an image output complying with the intention of a user who desires a composite image output corresponding to the color mode of an input image. SOLUTION: An image input processing section 5003 acquires an original image 5004 from a scanner section 5001 or a PDL development section 5002 and discriminates the color mode of the image. An image composition section 5007 acquires a water mark image 5006 among a plurality of images stored in a hard disk 5005 and its color mode and combines both the original image and the water mark image to produce a composite image 5008. Then the image composition section 5007 sets a color mode at an output of the composite image by utilizing the color mode of the original image 5004 and the color mode of the watermark image 5006.
