<P>PROBLEM TO BE SOLVED: To provide a fixing device in which a non-contact electrode is disposed in the vicinity of an exit from which transfer paper is ejected, a voltage for attracting the transfer paper is applied to the electrode before the leading end of the transfer paper ejected from the fixing device is attracted to a heat member, and thereby the transfer paper is conveyed without its leading end being attracted to the fixing device and is ejected without causing a paper jam, and to provide an image forming apparatus having the fixing device. <P>SOLUTION: The fixing device A fixes a toner image such that transfer paper with a toner image transferred thereon is conveyed while held between two members 30 and 31 heated while pressed to each other. In the fixing device A, a non-contact control electrode 41 is disposed in the vicinity of the exit of the device A from which the transfer paper is ejected.
