PROBLEM TO BE SOLVED: To provide a data transmitting apparatus for alleviating stress at a reception side caused by the impossibility of continuous reception of information providing service and caused by the reduction of a communication speed by congestion after the interruption of communication. SOLUTION: The data transmitting apparatus includes a receiving means 30 for receiving the download request of streaming content information and a permission buffer amount from an in-vehicle streaming reproducing apparatus 10; a transmitting means 33 for transmitting the streaming content information to the streaming reproducing apparatus; a communication information acquiring means 31 for acquiring a communication possible time and a communication impossible time calculated by a road information collecting center 14 and a communication bit rate, based on traveling information and road traffic information; and a reproduction bit rate calculating means 32 for calculating the reproduction bit rate of the streaming reproducing apparatus, based on the communication possible time, etc., and the permission buffer amount.
