PROBLEM TO BE SOLVED: To provide a recording and reproducing device of a digital recording medium that has a editing function which can go back to the past to record. SOLUTION: This digital recording and reproducing device can edit tracks where audio data are recorded in a data region according to control information. It has a means of always cyclically recording by using the whole unused area of the data region, a tentative track marking means to give a tentative track mark when receiving an instruction to record and to record it in a control area, and to make the previously recorded data the first track and the next recorded data the second track, a tentative track mark position adjusting means to adjust the tentative mark position after setting a tentative track mark or after finishing the recording, and a track registration selection means to register the second track after the final adjustment of the tentative track mark position and to decide to register the first track or to make it a vacant region.
