PURPOSE: A contents data recording device and a contents data recording method are provided to manage an area of a magnetic disk, and to preserve the contents of a recorded broadcasting program to an indicated time from a program start time even though a recording preservation is indicated after starting the program. CONSTITUTION: A receiving unit receives contents data. A recording unit records the received contents data in the first area(23) of a recording medium to replace with old contents data existing in the first area(23). An input unit inputs a recording preservation indication to preserve the recorded contents data. A copy unit copies predetermined contents data into the second area(22) if the predetermined contents data exists in the first area(23) and a capacity of the second area(22) is enough to preserve the recorded data.
