PURPOSE: A device and a method for informing whether an Ethernet network is congested are provided to inform a host or a server located at an end of a communication network whether a congested section is generated, so that the host or the server can actively control the quantity of packets, thereby reducing a continuous congestion time. CONSTITUTION: Line interfaces(21a,21b) automatically set an Ethernet packet transmission rate of an external device according to a transmission rate supported by an Ethernet switch(30), and interface Ethernet packets transceived between the external device and the Ethernet switch(30). A switching unit(22) senses whether a new Ethernet packet is received through the line interface(21a), and switches an Ethernet packet temporarily stored in a buffer(24) to a corresponding port/link. A switching controller(23) senses whether a new Ethernet packet is received through the switching unit(22) to store the packet in the buffer(24), and perceives an optimum path for retransmitting the received Ethernet packet. The buffer(24) temporarily stores the received Ethernet packet.
