PROBLEM TO BE SOLVED: To provide a variable rate communication method capable of maintaining the transmission of user data at a high transmission rate as much as possible even when the capacity of the user data exceeds the transmission power limit of a terminal. SOLUTION: A transmission power instruction part 103 computes the current transmission power of the terminal from initial transmission power specified from a base station and the volume of data to be transmitted. Then whether the transmission power of a DPCCH (discrete physical control channel) + DPDCH (discrete physical data channel) exceeds the maximum power (transmission power limit) of the terminal or not is decided, and when the transmission power exceeds the maximum power, the transmission data format of the DPCCH is changed or the pilot information of the DPCCH is transmitted at a burst, so that the transmission power of the DPCCH is reduced and the reduced power is used for the transmission power of the DPDCH.
