PROBLEM TO BE SOLVED: To provide a dry toner which satisfies simultaneously small particle diameter and the powder fluidity, release property and low temperature fixing property of a spherical toner for obtaining high picture quality in an electrophotographic toner. SOLUTION: The dry toner contains at least one kind of modified polyester as a toner binder and contains at least one kind of wax. In the IR absorption spectrum of the toner obtained by a total reflection measurement method using an ATR (attenuated total reflection) crystal having a refractive index of 4.0, the ratio of intensity at the absorption band attributable to the CH stretch vibration of the wax to the absorption band attributable to the CH stretch vibration of the toner binder is 1.7 to 3.0 at 45°incidence angle of IR light and 0.9 to 1.5 at 22.5°incidence angle of the IR light.
