<P>PROBLEM TO BE SOLVED: To speed up and facilitate formation and confirmation of a middle area in a recording medium of a rewritable opposite track path having a plurality of recording layers. <P>SOLUTION: Intermediate area management information (middle status) which indicates whether a intermediate area for guarding (middle area) whose one end is an inter-layer shifting position (inter-layer loopback address) which is fixed according to user data recording is already formed or not is made to be recorded in a predetermined management information area (for example, lead in) of a disk.
