PROBLEM TO BE SOLVED: To provide a heat-sensitive element capable of using both of resin and alloy as a fusible material, preventing oxidization of the fusible material, and preventing operation failure caused by stress concentration deformation of the fusible material even in a stress type, and to provide a thermo-protector using the heat-sensitive element. SOLUTION: The fusion material 11 is filled in an external capsule 12 having an insulating film 121 in a state that the insulating film 121 is stretched, and the thickness or height of the extra capsule 12 is increased by the fusion of the fusible material 11.
