PURPOSE: An apparatus for protecting the overcharge of a battery is provided to protect the overcharge of a rechargeable battery from overvoltage by checking the voltage of a receptacle battery terminal and stopping the charging operation of the battery when the checked voltage exceeds a threshold level voltage. CONSTITUTION: An internal charging circuit part(300) in a mobile terminal is connected with a CLC(Cigar Light Charger)/PHF(Portable Handsfree kit) receptacle charging unit(100) and an AC/DC adapter(400). A self-contained charging circuit part(310) in the internal charging circuit part(300) connects a battery(330) and a main circuit(320). The charging of the battery(330) is made after the voltage supplied from the AC/DC adapter(400) is processed through a field effect transistor(311) and a current sensing resistor(312). In case that the charging voltage of the battery(330) exceeds 4.2V, a full-charging voltage, a battery voltage check interface circuit(353) in an overcharge protection circuit(350) senses the overcharged over voltage and transfers it to an MSM control part(354). The MSM control part(354) activates a constant voltage circuit(351) in the overcharge protection circuit(350).
