PURPOSE: A rake receiving device in a DS(Direct Sequence) CDMA mobile communication system and a method are provided to prevent a fat finger phenomenon when a finger for demodulating multi-path signals having different time delays tracks the same path, thereby guaranteeing a time diversification effect. CONSTITUTION: Fingers(730,740) receiving an initial demodulation command track assigned multi-path signals, and demodulate the tracked multi-path signals. Demodulation symbol strings demodulated by the fingers(730,740) are transmitted to a combiner(750). The fingers(730,740) measure quality of the multi-path signals to report the measured results to a controller(710). Each of the fingers(730,740) internally generate timing control signals by tracking the multi-path signals by code tracking units(736,746). The controller(710) receives the timing control signals, and determines a timing control signal to be used by the fingers(730,740) according to threshold values and the timing control signals.
