PROBLEM TO BE SOLVED: To provide a charging member that prevents holes from being made by toner during durability use and obtains a high quality image for a long time and to provide a charging device using the member. SOLUTION: The charging member charges a body to be charged, by applying a voltage between the member and the body while the member and the body are in contact with each other. The charging member has at least an elastic layer 2 and a surface layer 5 in that order from inside. An intermediate layer 4 is disposed between the elastic layer 2 and the surface layer 5, the film thickness of the intermediate 4 is 50μm or more. In addition, the tensile breaking strength of a resin material that is the main constituent of the intermediate layer 4 is 10 to 25 N/mm<SP>2</SP>and the breaking elongation of it is 300 to 1,500%. The charging device includes: the charging member that is in contact with the body to be charged and charges the body; and a voltage application means that applies a voltage between the body and the charging member.
