PURPOSE: A method for determining transfer speed and a communication system using the same are provided to transmit information necessary for required processing more certainly, even in the case of communicating at a variable bit rate. CONSTITUTION: A communication system(100) comprises a terminal system(10), a base station system(12), and a network(48). The terminal system(10) comprises an operation part(14), a processing part(16), a modulation/demodulation part(18), a modulation type determination part(20), a QoS measurement part(22), an RF part(24), a control part(26), and an antenna(28). The operation part(14) is an interface to input data from the external. The processing part(16) modifies a signal, inputted from the operation part(14), so as to be modulated at the modulation/demodulation part(18). The modulation/demodulation part(18) modulates information to be transmitted, and demodulates received information. The QoS measurement part(22) measures the QoS of a received signal. The modulation type determination part(20) determines a modulation type according to the measured QoS and creates a signal to notify the base station system(12) of the determined modulation type. The RF part(24) performs the frequency conversion, amplification, A/D or DA conversion between a baseband signal and an RF signal. The antenna(28) transmits and receives RF signals. The control part(26) carries out the timing processing of the terminal system(10) and the processing of control signals.
