PROBLEM TO BE SOLVED: To provide a recording and reproducing device which can record new contents without erasing contents being already recorded contrary to intention of a user independently of presence/absence of the user, also without interrupting contents, further suppressing influence when already recorded contents are auditioned to the minimum, when empty capacity of the recording medium is deficient. SOLUTION: When it is discriminated by an empty region discriminating part 24 that empty region in a recording medium 15 is deficient, erasing object contents being the object of erasing is selected from contents already recorded in the recording medium 15 by an erasing object selecting part 22. An erasing region deciding part 21 decides an erasing region to be erased out of regions in the recording medium in which selected erasing object contents are recorded, a recording control part 23 recognizes the selected erasing region as an empty region, and controls new recording for the empty region.
