The device has two magnetic units (10, 20) displaced one with respect to another for determining a braking force to open a frame e.g. tail gate (5) between a closing position and an intermediary opening position. The displacement of the magnetic units determines multiple stable positions of stopping the frame between the intermediary opening position and a maximum opening position. The magnetic unit (10) is mounted on a horizontal axis (6) of the frame (5) and the other magnetic unit (20) is connected to a fixed part (8). An independent claim is also included for a motor vehicle with a tail gate.
