PROBLEM TO BE SOLVED: To avoid that the interchangeability of an information recording medium exclusive for reproduction is lost in the recording operation with respect to the information recording medium having a plurality of recording layers due to the unrecorded area caused by the completion of the recording operation half way of the data area, and to keep the interchangeability. SOLUTION: For instance, when the recording of user's data is completed half way X of the data area on a layer 1 like (b), the recording is made on the unrecorded area caused on the layer 1 by e.g. a lead-out like (b-1) or dummy data, etc., having an attribute of user's data like (b-2). Also, e.g. when the recording of the user's data is completed half way Y of the data area on a layer 0 like (c), the lead-out like (c-1) or the dummy data, etc., having the attribute of user's data like (c-3) are recorded on the specific unrecorded area on the layer 1. Thus, by covering the unrecorded area with the data, the interchangeability is maintained with the information recording medium exclusive for reproduction having a plurality of recording layers.
