<p><P>PROBLEM TO BE SOLVED: To perform high-quality packet transmission by avoiding the congested status of a neighboring router without imparting information about a configuration of a network, the congested status and the neighboring router. <P>SOLUTION: A monitor packet generating part 319 generates a monitor packet for monitoring the congested status of the neighboring router. A monitor packet inserting and sending part 324 sends the monitor packet to the neighboring router. A delay time time-out determining part 321 receives the monitor packet sent from the monitor packet inserting and sending part 324 and sent back from the neighboring router and finds a delay time of the monitor packet.
