PROBLEM TO BE SOLVED: To provide a light emitting element having new structure formed on a silicon substrate, and to provide its manufacturing method. SOLUTION: The light emitting element 100 comprises a silicon substrate 110, a buffer layer 120 which is formed on the substrate 110 and composed of oxide containing at least one of rare-earth metal and alkaline earth metal, and an emission member composed of compound semiconductor formed on the buffer layer 120. The emission member comprises at least a lower cladding layer 124, an upper cladding layer 142 and an active region 130 arranged between the lower cladding layer 124 and the upper cladding layer 142.
